STJD acquits Bruno Henrique for fraud linked to betting

THE Supreme Court of Sports Justice for Football (STJD) decided, this Thursday (13), to absolve the player Bruno Henrique for fraudulent conduct linked to betting, and reversed the punishment of game suspension. The player received a fine of R$100,000, the maximum amount foreseen.

By six votes to three, the Plenum of the STJD reformed the first instance decision and classified the player under article 191 of the Brazilian Code of Sports Justice (CBJD), which deals with non-compliance with regulations.

The session was resumed after a request for review on Monday (10). Rapporteur Marco Choy stated that the case is restricted to the sharing of sensitive information, differentiating it from episodes of Operation Maximum Penalty. He voted to acquit the athlete under article 243-A (manipulation) and apply the penalty provided for in article 191, being accompanied by four other auditors.

Auditor Maxwell Vieira defended a harsher sentence and considered that Bruno Henrique went beyond a sporting strategy, providing his brother with information that would have enabled a betting scheme. He voted to maintain the capitulation for manipulation, with a fine of R$75,000 and suspension for 270 days — a position also followed by auditors Mariana Barreiras and, in part, by Luiz Felipe Bulus, who defended the maintenance of the original punishment of 12 matches.

The auditors who accompanied the rapporteur argued that, although serious, the conduct does not fall under the articles of manipulation. The president of the STJD, Luís Otávio Veríssimo, ended the trial by reaffirming that the club’s defensive attitude reinforced the departure from article 243. For him, the central problem is not the yellow card itself, but the sharing of sensitive information, which compromises sporting integrity.

With the decision, Bruno Henrique is free from suspension, but must pay the maximum fine provided for infractions of article 191.
