THE Attorney General of the Union (AGU) submitted a request to the Federal Supreme Court (STF) to clarify the decision of the virtual plenary that expanded the operations of state lotteries. The body filed, on Wednesday (19), embargoes for clarification arguing that the ruling left loopholes that could allow bets to exceed the territorial limits defined by law.
According to information from the PlatôBRthe AGU maintains that the STF’s decision should not apply to betting, since this modality has its own regulations and is the target of other actions being processed in the Court. The appeal asks the court to reinforce the territoriality requirement for state betting, suggesting measures such as the use of georeferencing to prevent bettors from other states from accessing local platforms.

The body also defends that the Supreme Court recognizes the ban on digital advertising of state bets outside the state of origin. According to the AGU, advertisements with links function as a “gateway” for bets placed beyond permitted borders, which would violate the principle of action limited to state territory.
The questioned decision overturned federal rules that prevented companies from operating lotteries in more than one state and authorized the advertising of state lotteries outside their territories. AGU, however, wants to ensure that this expansion does not extend to bets, which drive a billion-dollar market and remain under legal debate in the country.
