THE Union Court of Auditors (TCU) determined that the Ministry of Finance adopt, within 120 days, measures to ensure that the Prizes and Betting Secretariat (SPA) has human, technological and budgetary resources compatible with its functions of regulating and supervising the sports betting market. The decision took place during a plenary session held this Wednesday (3).
The collegiate unanimously approved Ruling TC 24,430/2024, which analyzes the actions of the Secretariat of Prizes and Bets (SPA) and the Financial Activities Control Council (Coaf) in combating money laundering in the betting market.
According to the case’s rapporteur, minister Jhonatan de Jesus, the lack of structure significantly compromises the secretariat’s performance. “There is no point in having a robust regulatory framework if the regulatory entity does not have the servers, systems or budget to enforce it,” he stated.
“In short, it is pointless to establish strict rules on paper without providing the SPA with minimum material conditions to supervise their compliance. The current situation creates merely formal regulation, reduces supervisory capacity and, consequently, the expectation of control over operators, increasing the risk that the Brazilian betting market will be used for illicit purposes”, he added.
The TCU also recommended that the SPA formalize, in manuals or technical documents, the routines and criteria for its activities, after an audit identifies the absence of standardized procedures. For the rapporteur, this gap “allows for subjectivity in analyzes and compromises the transparency of control actions”.
The Court of Auditors also informed that it will continue to monitor the actions of the SPA, considered a key player in the implementation of the new regulatory framework for betting in the country.
