THE Senate approved, this Wednesday (10), by 64 votes to zero, the Antifaction PL, which toughens penalties against factions and militias and creates Cide-Bets, a new contribution on sports betting to finance public security actions and the prison system. The rapporteur’s estimate, senator Alessandro Vieira (MDB-SE), is that the measure will generate up to R$30 billion per year. As it was changed, the text returns to the Chamber of Deputies.
The Antifaction PL was approved by the Constitution and Justice Committee (CCJ) of the Senate this Wednesday and went to a plenary vote. According to estimates cited by Vieira, based on data from the Central Bank, Cide-Bets could allocate up to R$30 billion per year for the sector. The rapporteur highlighted that the contribution will be provisional in nature, in force until the Selective Tax provided for in the tax reform comes into force.
Cide-Bets will focus on transfers made by bettors to betting platforms — and not on companies’ profits — at a rate of 15%. According to the text, 60% of the revenue will be transferred to the states, through state public security funds, and earmarked exclusively for actions to combat organized crime and expand the prison system.
The proposal also reformulates the governance of the National Public Security Fund (FNSP), which now has representatives from the Public Ministry and the Judiciary. Furthermore, the Special Action Groups to Combat Organized Crime (GAECOs) will be direct beneficiaries of the new resources.

Cide-Bets and financing

On the tax front, the project creates the Single Declaration of Regularization, allowing irregular betting operators to settle tax debts accumulated over the last five years, under penalty of account blocking and loss of funds to the FNSP.
Although the central theme is financing via Cide-Bets, the Antifaction PL also establishes a legal framework to combat organized crime, consolidating provisions of the Penal Code, Criminal Organizations Law and other legislation. The text provides for sentences of 15 to 30 years for joining or financing criminal factions, which are now classified as heinous crimes, with no possibility of amnesty, pardon, pardon, bail or conditional release.
The rapporteur reinforced that the creation of Cide-Bets is a measure of financial suffocation for the factions, transforming the revenue from bets into direct investment in public security. The project was approved unanimously, with support from the government base and the opposition, and must return to the Chamber under the report of deputy Guilherme Derrite (PP-SP).
