THE Prizes and Betting Secretariat (SPA) of the Ministry of Finance established, through the SPA/MF Ordinance No. 230/2026the Commercial Promotions Working Group, responsible for supporting the review of the rules and procedures that regulate the free distribution of prizes — such as raffles, gift vouchers and competitions — carried out for promotional purposes.
According to the text published in the Official Gazette of the Union, the group is based on the conclusions of Regulatory Impact Analysis Report No. 5/2025 and should propose measures to modernize and simplify the process of authorizing commercial promotions, strengthen control mechanisms and prevent fraud and irregularities.
Among the group’s responsibilities are the study of simplifying authorizations for lower value promotions, the possibility of multiple authorizations, the review of administrative penalties, and the analysis of the feasibility of allowing promotions related to the sale of tickets for shows, which are currently prohibited.
The ordinance also provides for the creation of regulatory performance indicators, the implementation of risk-based inspection models, and the improvement of the Commercial Promotions Control System (SCPC), with a focus on automation and transparency of processes.
The group will be made up of representatives from the sub-secretariats of Authorization, Monitoring and Inspection, Sanctioning Action, in addition to the SPA Office and the General Coordination of Regulation — which will coordinate the work. Meetings will take place every 15 days, with the possibility of extending the initial period of 75 days.
According to the ordinance, members’ participation is considered a relevant public service, without remuneration, and the final report will be sent to the Secretary of Prizes and Bets at the end of the work.
