THE Attorney General of the Union (AGU) filed an appeal against the decision of Minister Luiz Fux, of the Federal Supreme Court (STF), which partially suspended the blocking of accounts of beneficiaries of social programs, such as Bolsa Família and Benefício de Prestação Continuada (BPC), on online betting platforms.
The manifestation, according to the AGU, highlights the “technical impossibility” of complying with the court order because there is no mechanism capable of distinguishing whether the values used in betting originate from assistance benefits.
In 2024, Minister Fux had decided that beneficiaries of social programs would not be able to bet on betting sites (“bets”), determining measures to prevent the use of public resources for this purpose, after the STF plenary demanded government action to protect families in vulnerable situations.

To comply with the decision, the government published rules that block the creation of accounts and the use of beneficiary CPFs on betting sites. However, in December last year, Fux partially responded to a request from the regulated sector and suspended the effectiveness of part of this block, maintaining only the ban on new registrations — and determining that existing accounts be reactivated until the issue is resolved in court.
In the appeal presented to the STF, the AGU argues that the Prizes and Betting Secretariat of the Ministry of Finance reported the lack of a technological solution that allows identifying whether or not the resources used in betting derive from social benefits, making the practical implementation of the court decision as written unfeasible.
