What is Kalshi?
THE Kalshi is an American platform prediction marketswhere users negotiate contracts about future events — such as elections, the economy and, more recently, sports. The company is regulated by Commodity Futures Trading Commission (CFTC) and is based in Massachusetts.
This week, Kalshi won a partial victory in Massachusetts, but suffered a major setback in Nevadaone of the strictest states in the world when it comes to betting and gaming.
What happened in US courts
- In Massachusettsthe Court temporarily suspended a decision that prohibited Kalshi from offering contracts linked to sports.
- Already in Nevadathe Federal Court denied the company’s request and local regulators took action to block the operation, classifying the contracts as “unlicensed betting”.
The state of Nevada is the heart of the regulated betting market in the USA (Las Vegas), which makes the conflict even more symbolic.
Why this matters for Brazil
This case turns direct reference for the Brazilian betting and iGaming marketespecially:
- 📌 Show the conflict between prediction vs. forecast markets sports betting
- 📌 Reinforces that local regulation prevailseven when the company is authorized at federal level
- 📌 Serves as a warning for “alternative” models that attempt to operate outside of traditional licensing
With Brazil in the regulatory consolidation and in period of greatest political sensitivity (elections)this type of dispute in the USA becomes a thermometer for:
how Brazilian regulators can react to new “grey zones” in the betting market.
Strategic insight for operators in Brazil
- Innovative models (like prediction markets) may clash with local regulations
- Have a federal license does not guarantee state operation (direct parallel with Brazil: federal authorization ≠ acceptance by regulators and MP)
- States/countries with a strong gaming industry tend to protect traditional licensed operators
