Chamber approves Antifaction PL, but removes CIDE-BETS from the text

THE Chamber of Deputies approved on Tuesday night (24) the Anti-Faction Bill, aimed at combating criminal organizations, without the inclusion of taxation of sports betting houses (bets) known as CIDE-BETS. The withdrawal was made through a statement approved in plenary and must be sanctioned by the President of the Republic.

The proposal, authored by the Executive Branch, increases penalties and typifies conduct related to organized crime, but CIDE-BETS — which provided for taxing bets at 15% to finance public security — was removed from the final text. The initial idea was that the contribution would focus on transfers of resources from bettors to operators until the Selective Tax provided for in the tax reform came into force.

The project’s rapporteur in the Chamber, deputy Guilherme Derrite (PP-SP), had accepted the Senate amendment that created CIDE-BETS, but in plenary he decided to accept the highlight that excluded the charge, relocating the tax discussion to another legislative project. According to the original proposal, the tax could be used to finance security actions and modernization of prisons, in addition to allocating resources to combat organized crime.

The exclusion from taxation was defended by deputies who argued that the creation of a new tax could affect the competitiveness of the legalized betting sector and increase the risk of bettors migrating to the illegal market. The highlight also removed other rules related to the regularization of taxes owed by betting companies in recent years.

The president of the Chamber of Deputies, Hugo Motta (Republicans), stated during a press conference on Tuesday night (24) that the bet tax will be voted on separately from the Antifaction PL. Now, according to Motta, the proposal will be presented as a highlight, separate from the project, by the rapporteur of the text in the Chamber, deputy Guilherme Derrite (PP).
