Project that doubles betting taxes could yield R$ 18 billion, rapporteur estimates

Senator Eduardo Braga (MDB-AM), rapporteur of the Bill 5,473/2025estimated that the increase in taxation on bets and fintechs could generate up to R$18 billion in revenue between 2026 and 2028. The proposal, authored by senator Renan Calheiros (MDB-AL), will be analyzed this Tuesday (4) by Economic Affairs Committee (CAE) of the Senate.

The text was presented last week with the aim of resuming points of the Provisional Measure after the filing of Provisional Measure (MP) 1,303/2025, which provided for alternatives to the greater increase in the Tax on Financial Operations (IOF), blocked in the Chamber. At the beginning of October, the Chamber removed the MP from the agenda, which had already been approved by the Joint Congressional Committee, chaired by Calheiros, but ended up expiring due to the end of its validity period.

According to Braga, the fiscal impact would be R$4.98 billion in 2026, R$6.38 billion in 2027 and R$6.69 billion in 2028. The largest volume, around R$13.3 billion, would come from increasing the rate on fixed-odds bets, from 12% to 24%.

The project determines that the additional 12 percentage points charged to betting operators be allocated to the Union’s social security, but provides that part or all of this collection, between 2026 and 2028, can be passed on to states, the Federal District and municipalities to compensate for revenue losses resulting from the expansion of Income Tax exemptions on their payrolls.

A bill to legalize casinos in Brazil is expected to be voted on in the Senate by the end of the year.

Bill No. 2,234/2022, which proposes the legalization of casinos, bingo halls, jogo do bicho (animal gambling), online betting, and horse racing in Brazil, is ready for a vote in the Senate plenary. The bill’s vote now depends on an agreement to return to the plenary session.

The proposal has already been approved by the Chamber of Deputies and received a favorable opinion from the Senate’s CCJ in June 2024, through a report by Senator Irajá (PSD-TO). The bill defines conditions for the operation of these activities, casinos installed in resorts or integrated leisure complexes, state limits, minimum capital requirements, equipment inspections, and specific taxation, among other rules.

Behind the scenes, Davi Alcolumbre has supported the bill and is evaluating the ideal time to table it in the plenary session. The rapporteur, Senator Irajá (PSD-TO), expects the bill to be voted on by the end of this year. In July 2025, the bill was on the agenda, but was postponed due to a lack of quorum.

The bill faces resistance, especially from the evangelical bloc and from members of parliament who raise concerns about social risks, such as gambling addiction, corruption, and money laundering. The bill has the support of the Ministry of Tourism.

“As a government agency dedicated to tourism development, we support the proposal, as do other ministries. We want to attract more visitors and encourage the movement of people within Brazil,” said Tourism Minister Celso Sabino in a press conference.

If approved, the bill will give the federal government up to one year to regulate the activity. The rapporteur himself emphasizes that it will not be possible to open casinos immediately; the entire implementation process could take up to three years.
