THE government of Maranhão went to the Federal Supreme Court (STF) this Wednesday, 5th, in defense of the betting houses, the popular bets. The state attorney’s office filed a request to join as amicus curiae (Latin expression meaning “friend of the Court”) in one of the lawsuits asking for the Sports Betting Law to be declared unconstitutional. Maranhão is governed by Carlos Brandão (PSB), a former ally of Flávio Dino, who is now a minister in the STF.

This type of participation in the process does not make the government of Maranhão a party — it is as if it asked to be a kind of “advisor”, who will contribute with arguments that help the Court to make a decision. The actions that question the constitutionality of bets are stopped at the STF. The rapporteur is by Minister Luiz Fux.

“Contrary to the applicant’s allegations, the Bets Law promotes a safe and controlled gaming environment, establishing strict measures to prevent addiction and default. Appropriate regulation, instead of aggravating social problems, mitigates them through control and prevention measures expressly provided for in the law itself”, says an excerpt from the statement sent by the Maranhão government to the Supreme Court this Wednesday.

Elsewhere, the petition says: “The regulation of sports betting brings significant benefits to the Brazilian economy and society. Firstly, the regulated sector creates formal job opportunities in several areas, from technological development to customer service, contributing to the reduction of unemployment. Furthermore, the regulated activity generates substantial tax revenues for the Union, States and Municipalities, strengthening public finances.”

One of the justifications that the Maranhão government gave for joining the process was the creation of Lotema, a state lottery. If the actions are deemed valid, he could lose it. “All studies and procedures for implementing the Maranhão State Lottery were carried out with the establishment of strict criteria for the accreditation of operators in the State, supported by state and federal legislation for operation,” he argued in the action.

The requests to overturn the Sports Betting Law in the Federal Supreme Court were presented by the National Confederation of Commerce (CNC) and the Attorney General’s Office (PGR), through two separate legal actions.

THE Economic Affairs Committee (CAE) postponed until Wednesday (5) the analysis of the bill that increases taxation on bets and fintechs. The report by senator Eduardo Braga (MDB-AM) was read this Tuesday (4) by senator Fernando Farias (MDB-AL).

Senator Renan Calheiros (MDB-AL), author of the proposal and president of CAE, gave a collective view to the matter. PL 5,473 was presented as a complement to PL 1,087/2025, which exempts those earning up to R$5,000 per month from Income Tax (IR) and increases taxation on high incomes.

The project is being processed on a final basis, that is, it will not need to be voted on in the Senate plenary. If approved by the CAE, it will go directly to the Chamber of Deputies.

Debate

The project’s rapporteur, senator Eduardo Braga, criticized the lobby against increasing taxation in the betting sector. According to the parliamentarian, the measure is fair and will face “brutal resistance”, adding that it will be the target of attacks by lobbyists.

“I am referring to the proposal to increase the contribution of bets from 12% to 24%. I do not lack courage, however I want to give everyone the right to debate the amendments presented”, said Braga, referring to the lobby in favor of bets.

Senator Angelo Coronel (PSD-BA) defended a more effective fight against the illegal betting market. “It is not honest to increase the tax burden on those who are legal and forget about those who work underground,” he said.

“The fear we have is that, regarding these bets, if this tax burden increases, as is being proposed, there will be an escape from them, as happened in Germany, as happened in Portugal. How will they increase, have an increased tax burden, if the government is not doing anything to close the doors of clandestinity?”, he asked.

Senator Soraya Thronicke (Podemos-MS) stated that it is necessary to intensify the fight against illegal betting. She said she considers the contribution currently made by these groups to be small, which “experience a unique blessing”.

About the project

The text doubles the Contribution on Gross Gaming Revenue, which will increase from 12% to 24%. It also creates the Tax Regularization Program for Low-Income Individuals (Pert-Low Income) and corrects a distortion related to the remittance of profits and dividends to beneficiaries abroad.

In addition, it increases the CSLL from 9% to 15% for fintechs and payment institutions, over-the-counter market administrators, stock and commodity exchanges, among others matched by the National Monetary Council. Capitalization companies and credit, financing and investment institutions will have the rate increased from 15% to 20%.

The general director of Federal Police (PF), Andrei Rodrigues, stated this Monday (3) that taxing bets is a “central agenda” for public security. The statement was made during a public hearing at Chamber of Deputies to debate the Security Amendment Proposal to the Constitution (PEC).

The proposal, which is being processed in the Chamber, increases the allocation of resources from bets to finance security. The speech by the general director of the PF comes amid the repercussions of the mega police operation carried out in Rio de Janeiro.

Andrei Rodrigues defended the proposal and reiterated that “it is a central issue”, as it would guarantee more resources for the police, including the PF, which currently receives only 0.5% of the amounts collected by the sector

“This is a central issue, and this would come not only for the Federal Police, but for all the police forces in Brazil, it would come in a very encouraging way so that we would have an increase in the allocation of resources to the sector. Knowing the gain, the profitability of these bets, taxation for Security is a central point. Today, the Federal Police has only 0.5% allocation of this resource, and that could also be increased”, he said.

The suggestion to increase bet resources allocated to security was made by deputy Alberto Fraga (PL-SP), coordinator of the Parliamentary Security Front, known as the bala bench.

Bet Taxation

Recently, the Lula government tried to increase the taxation of bets through a Provisional Measure, but the text ended up expiring after losing support in Congress. Now, the government is looking for new proposals to expand taxation of the betting sector in the country.

The new project increases the bet rate to 24%, a higher percentage than the provisional measure that expired at the beginning of October. The Lula government’s MP predicted a tax of 18% on gross revenue from online betting and gambling, known by its acronym in English as GGR (Gross Gaming Revenue).

The National Association of Municipal and State Lotteries (Analome) will be widely represented in the IGI Expo 2025which takes place on November 12th and 13th, at Blue Tree Morumbi, in São Paulo. At 10 am on November 12th, Horn will be a speaker on the panel “The importance of law in the regulated environment”, alongside Luiz Felipe Santoro (OAB-SP), Sofia Monteiro (OAB-PE), Ricardo Feijó (OAB-PR) and Victor Amado (OAB-GO). The debate will address the performance of the Gaming Law Commissions of the OAB sections and the role of law in consolidating the legal environment for betting and lotteries.

Later, at 4:05 pm, he returns as moderator of the panel “The role of States in regulating the lottery market: view of the regulator and operators”, with the participation of Oném Moreira (Loteria Mineira), Cassiano Pereira Jr. (Maranhão Parcerias), Roberto Souto (Mineira da Sorte Loterias) and Eduardo Paiva (Lottotins). To the Caixa Lotteries Mega da Virada 2025 sales began this Saturday, November 1st, with a prize estimated at a record R$850 million. Bets on the Mega-Sena special contest, number 2955, can be placed until December 31st.

The main prize of Mega da Virada does not accumulate, as is the case in other special contests. Therefore, if there are no winners in the 1st bracket (6 numbers), the prize will be divided between the winners in the 2nd bracket (5 numbers) and so on, according to the rules of the modality.

Prize could reach R$1 Billion

Caixa announced that, this year, the prize pool could be the largest in the history of the bank’s lotteries, reaching R$1 billion, depending on the volume of collection. The mega prize can be achieved after the federal government’s Prizes and Betting Secretariat changes the distribution of the collection percentages allocated to the Mega-Sena and Mega da Virada prizes, through the SPA/MF Ordinance No. 1,656.

Currently, the prize for the main track is estimated at R$850 million, exceeding by more than 33% the amount paid in the last edition, of R$635.4 million.

At the end of last year, the then president of Caixa Loterias, Luciola Aor Vasconcelos, had already signaled that, soon, the Mega da Virada prize pool could reach R$1 billion.

“We don’t have a projection, but considering the growth in recent years, I don’t think it will take long to have a billion-dollar prize. I prefer not to estimate because we don’t have that projection, but it will be soon”, he said in December 2024.

New schedule

Another change is that, from Monday (3), the time to place bets on all types of Caixa Lotteries, including Mega da Virada, will be extended. Players will have an extra hour “to buy their prizes through the application and through the Loterias Caixa portal, being able to purchase their shares until 8:30 pm”.

Bolão

To participate in a Mega-Sena prize pool, bettors can purchase shares organized by lotteries, which may charge an additional service fee. It is also possible to purchase shares through the Loterias CAIXA portal or through the Loterias CAIXA application. When the pool is organized by the bettor himself, there is no service fee charged.

The CAIXA Lottery pool is the bettor’s way of placing group bets. Just fill in the appropriate field on the steering wheel or ask the lottery attendant.

​In Mega-Sena, it is possible to make a pool of at least 2 and a maximum of 100 odds, with up to 10 bets per receipt. In the case of a pool with more than one bet, all of them must contain the same number of prediction numbers.

The senator Renan Calheiros (MDB-AL) presented, this Wednesday (29), Bill 5,473/2025, which resumes the increase in taxation on online betting, the so-called bets, and on financial institutions, with the aim of compensating for the loss of revenue resulting from the expansion of the Income Tax (IR) exemption range.

The proposal was filed one day after the senator met with the Minister of Finance, Fernando Haddad, reveals the Look. At the beginning of the month, the Chamber of Deputies removed the Provisional Measure 1,303/2025an alternative to the increase in the Tax on Financial Operations (IOF). The MP had been approved by the Joint Congressional Committeechaired by Calheiros, but ended up expiring due to the end of its validity period.

The new project increases the taxation of bets from 12% to 24%, a higher percentage than the provisional measure that expired at the beginning of this month. The Lula government’s MP provided for a tax rate of 18% on gross revenue from online betting and gambling, known by its acronym in English as GGR (Gross Gaming Revenue).

Calheiros’ text determines that the additional 12 percentage points charged to betting operators be allocated to the Union’s social security, but provides that part or all of this collection, between 2026 and 2028, can be passed on to states, the Federal District and municipalities to compensate for revenue losses resulting from the expansion of Income Tax exemptions on their payrolls.

“In financial terms, it is expected that the measure (which affects bets) will raise R$ 3.4 billion, R$ 4.8 billion, R$ 5.1 billion, respectively, in 2026, 2027 and 2028, based on the first semester report released by the Prizes and Bets Secretariat of the Ministry of Finance”, writes the senator.

Currently, Law No. 14,790/2023 determines that 88% of gross betting revenue remains with platform operators, while 12% goes to social destinations. Calheiros’ project proposes changing this division, expanding the portion allocated to public collection.

Other points of the bill

In addition to bets, the text also increases the Social Contribution on Net Profit (CSLL) charged to companies in the financial system. The rate would go from 9% to 15% for banks, over-the-counter market administrators and stock exchanges; and from 15% to 20% in the case of fintechs.

The proposal also creates the Tax Regularization Program for Low-Income Individuals (Pert-Low Income). The project was forwarded to the Economic Affairs Committee (CAE) and is being reported by Senator Eduardo Braga (MDB-AM).
