The Prizes and Betting Secretariat of the Ministry of Finance published this Tuesday (5) the SPA/MF Normative Instruction No. 3/2026which establishes the procedures that must be adopted by operators to prevent the registration and use of betting platforms by Novo Desenrola Brasil beneficiaries.
The standard regulates, in practice, the prohibition already provided for in the SPA/MF Ordinance No. 1,237/2026detailing how companies should identify and block these users.
The launch of Desenrola took place on Monday (4), with participants in the so-called program being prevented from accessing online betting platforms for a period of up to one year. In addition to the restriction on betting, the program allows the use of up to 20% of the balance of the Service Time Guarantee Fund (FGTS) to pay off debts.
According to the regulations, operators will be obliged to consult the Betting Management System (SIGAP) whenever there is an attempt to register or on the user’s first daily login. Verification will be done using the CPF.
If the system returns the status “Prevented – Programa Novo Desenrola Brasil”, registration must be denied. For existing accounts, the company will have up to three days to suspend it.
Before this, the user must be notified within one day, by email, SMS or other means, with the possibility of voluntarily withdrawing the amounts available in the account within two days.
If the withdrawal is not made, the operator must return the funds to the user. The rule also determines the cancellation of open bets, with a full refund of the amounts.
The regulatory instruction also obliges companies to record and maintain, for at least five years, all communications made with affected users. In addition, operators will have to inform SPA, via SIGAP, of the CPFs blocked with the status of “Suspension – Programa Novo Desenrola Brasil”.
Deadlines and penalties
Companies will have up to 10 days to implement the new rules. Within 15 days, they must carry out a complete scan of their databases to identify users who fit the restriction.
Failure to comply with obligations may result in the application of penalties provided for in sector regulations, including administrative sanctions.
