Project wants to ban bonuses and incentives in sports betting in Brazil

A Detailed Look at Monthly Spending

Bill No. 1018/2026 authored by the senator Eduardo Girão (NOVO-CE), proposes to expand restrictions on the sports betting market in Brazil, prohibiting mechanisms for encouraging and retaining users on the platforms. The proposal amends Law No. 14,790/2023, which regulates fixed odds betting in the country.

The text includes a new article in the legislation to prohibit practices that encourage an increase in the frequency, value or time spent by bettors on the platforms. Among the prohibited mechanisms are loyalty programs, cashback, promotions conditioned on deposits, missions, challenges and scoring systems based on user behavior.

The project also prohibits the sending of personalized communications based on the bettor’s history, such as notifications and messages that encourage the resumption or continuation of bets. Furthermore, it prevents the granting of benefits linked to accumulated losses, a practice considered to pose a risk for the development of compulsive behavior.

The proposal also determines that operators adopt measures to avoid directing incentives to users classified as high risk, in addition to ensuring transparency about digital systems that can influence players’ behavior, such as recommendation algorithms.

If approved, the text provides a period of 90 days for companies to adapt their platforms, contracts and commercial strategies to the new rules. The regulation of technical criteria will be the responsibility of the Ministry of Finance.

In justification, Senator Girão argues that, despite recent regulation in the sector, operators continue to use indirect strategies to encourage user engagement. According to the senator, these practices contribute to debt, compromising family income and worsening mental health problems.

The project is based on constitutional principles such as consumer protection and health protection, and seeks to limit what it classifies as mechanisms that induce compulsive behavior. The proposal will still be analyzed by Senate committees before going to a vote.
