THE Prizes and Betting Secretariat (SPA), linked to the Ministry of Finance, stated that it sees possible unconstitutionality in the law sanctioned by the governor of Rio Grande do SulEduardo Leite, which expands restrictions on betting advertising in the state.
Law No. 16,508/2026 was sanctioned on April 24 after approval of a project presented by state deputy Tiago Simon in the Legislative Assembly of Rio Grande do Sul. The rule establishes stricter rules for the dissemination of gambling in the state of Rio Grande do Sul.
In a note sent to the JOTA portal, SPA stated that it understands that the Federal Constitution exclusively attributes to the National Congress the competence to legislate on the subject, with the objective of guaranteeing regulatory uniformity throughout the country.
According to the secretariat, in situations such as the legislation approved in Rio Grande do Sul, federal control bodies, such as the Attorney General’s Office (AGU), can act to question the possible unconstitutionality of the rule in the appropriate sphere.

AGU was approached by JOTA to comment on the case, but reported that the position should be requested from the Civil House of the Presidency of the Republic. Until the publication of the original report, the organization had not commented.
The government of Rio Grande do Sul stated, through the state Civil House, that the law has parliamentary origins, was sanctioned by the governor and remains valid until a possible court decision determines its suspension.
The debate occurs amid advances in the regulation of the fixed-odd betting market in Brazil and discussions about limits for advertising in the sector in different states and at the federal level.
